Does the BFSG apply to your shop?

Since 28 June 2025, Germany's Barrierefreiheitsstärkungsgesetz (BFSG, the German implementation of the European Accessibility Act) applies to e-commerce services – online shops and ordering flows through which consumers conclude a contract. In practice, compliance is measured against EN 301 549 and WCAG 2.1 level AA.

Micro-enterprises providing services are exempt: fewer than ten employees and an annual turnover or balance sheet total of no more than €2 million. Whether your shop is affected, we clarify in a free first conversation – together with your legal adviser if in doubt.

Frequently asked questions

Since when does the BFSG apply?
Since 28 June 2025. Among other things, it covers online shops and ordering flows through which consumers conclude a contract.
Does the BFSG apply to small shops?
Micro-enterprises providing services are exempt: fewer than ten employees and an annual turnover or balance sheet total of no more than €2 million. Pure B2B shops are generally not covered.
Is an accessibility plugin (overlay) enough?
Overlay tools change how a page looks, but they do not fix errors in the code – such as missing labels in the checkout. That is why we work directly in your shop.
What goes into the accessibility statement?
Under Annex 3 BFSG, among other things: a description of the service, how the accessibility requirements are met, and the competent market surveillance authority.
How long does the implementation take?
That depends on the number of barriers and your shop system. After the audit we give you a fixed price and a schedule.
What happens in case of violations?
The German market surveillance authority for accessibility (MLBF) can require defects to be fixed and impose fines – up to €100,000 depending on the violation.
